Summary of The ILO Conventions : 107

Purpose of this Convention:

Having decided upon the adoption of certain proposals with regard to the protection and integration of indigenous and other tribal and semi-tribal populations in independent countries, which is the sixth item on the agenda of the session, and Considering that the Declaration of Philadelphia affirms that all human beings have the right to pursue both their material well-being and their spiritual development in conditions of freedom and dignity, of economic security and equal opportunity.

Gist of this Convention:

Governments shall have the primary responsibility for developing co-ordinated and systematic action for the protection of the populations concerned and their progressive integration into the life of their respective countries.Enabling the said populations to benefit on an equal footing from the rights and opportunities which national laws or regulations grant to the other elements of the population. Promoting the social, economic and cultural development of these populations and raising their standard of living. Creating possibilities of national integration to the exclusion of measures tending towards the artificial assimilation of these populations.

Definition of Indigenous People

Indigenous peoples are ethnic groups who are native to a land or region, especially before the arrival and intrusion of a foreign and possibly dominating culture. They are a group of people whose members share a cultural identity that has been shaped by their geographical region. A variety of names are used in various countries to identify such groups of people, but they generally are regarded as the “original inhabitants” of a territory or region. Their right to self-determination may be materially affected by the later-arriving ethnic groups.

ILO Convention 169 has given Tribal & Indigenous definition:

Tribal means:

“Traditional life styles, Culture and way of life different from the other segments of the national population, e.g. in their ways of making a living, language, customs, etc.; and Own social organization and traditional customs and laws.”

Indigenous means:

“Traditional life styles, Culture and way of life different from the other segments of the national population, e.g. in their ways of making a living, language, customs, etc.; and Own social organization and political institutions; and Living in historical continuity in a certain area, or before others “invaded” or came to the area.”

All CHT ethnic groups (Ex. Chamka, Tripura, Chak, Marma & etc.) are included above the ILO Convention 169 definition. Every group have own CULTURE, LIFE STYLE, LANGUAGE (words) & Customary Laws”
